Negligence of Will Drafters
You may be able to dispute a Will if it has been drafted negligently. Examples of potential negligence claims include where the Will prepared by a will draftsman:
- Fails to reflect the deceased's wishes in his/her Will to the detriment of disappointed beneficiaries.
- Where parts of the Will can not be interpreted in a logical/legal way or there were contradictory clauses and as a result of which the gift fails and falls either into the residue of the estate or under the intestacy rules.
- Does not comply with the legal formalities i.e it does not comply with the rules regarding execution of Wills.
- Where the will draftsman took too long to draft a Will and the deceased died before it was executed.
