Negligence of Will Drafters

You may be able to dispute a Will if it has been drafted negligently. Examples of potential negligence claims include where the Will prepared by a will draftsman:

  1. Fails to reflect the deceased's wishes in his/her Will to the detriment of disappointed beneficiaries.
  2. Where parts of the Will can not be interpreted in a logical/legal way or there were contradictory clauses and as a result of which the gift fails and falls either into the residue of the estate or under the intestacy rules.
  3. Does not comply with the legal formalities i.e it does not comply with the rules regarding execution of Wills.
  4. Where the will draftsman took too long to draft a Will and the deceased died before it was executed.
